1. Standard Warranty Guideline
ABS Computer Technologies, Inc. ("ABS") warrants the replacement or repair of an
ABS computer that is defective in material or workmanship for up to 1 year from
the invoice date (defined as the date the system is shipped by ABS) unless
otherwise specified on special items. This limited warranty covers only the
original software and hardware that was installed and purchased from ABS. If a
new part is replaced on the ABS system during the warranty period, the warranty
coverage period does not extend or change.
2. Exceptions to Warranty 2.1 Missing Items:
Missing items from your order MUST be reported to ABS within 10 business days
from the invoice date or the claim will be denied. All claims are subject to
verification by ABS.
2.2 Damaged Items & Inspection Policy:
Please inspect your products upon arrival to check for any damages to the
product. Please inspect your computer and all parts & peripherals for damage
upon arrival. All claims must be reported to ABS within 10 business days from
the invoice date or your claim will be denied. 2.3
ABS Brand parts and peripherals: All products within a 30-day period from the
date of purchase by the end-user may be credited, replaced or repaired. All
products purchased within a one-year period may be returned for repair (except
for some products that have longer warranty periods)
• If products are not purchased directly from ABS, please contact the
vendors or retailers from whom such products were purchased.
• Warranty only applies to defects in materials and/or workmanship, which occur
during normal use. • Warranty does not apply to those products that are damaged
due to misuse, abuse, negligence or modification by any party other than ABS.
• Warranty does not extend to any damage that occurs in shipment or due to
natural phenomenon (i.e. lightning or line surges).
• Warranty will be voided if the original serial number on the product is
removed, whether by accident or intentionally.
• Product purchase through auctions/online auctions/etc. will not be
covered by the manufacturer's warranty.
2.4 Parts & Peripherals: Peripherals purchased
for use with an ABS system are not covered under the Standard Warranty. The
Standard Warranty only applies to the computer and all components installed
within the computer. Parts & Peripherals are covered under the warranty outlined
in Section 7.
2.5 No Problem Found:
If a system that is returned to ABS for repair or replacement is deemed to be
working properly and not defective, the customer will be charged a $90
diagnostic fee and will be required to pay for return shipping. See Section 10
for RMA Shipping Policies.
2.6 The standard one-year warranty does not
cover the replacement of parts due to standard wear and tear during normal
operations including system fans, LEDs and lighting, cables, and the paint
finish.
2.7 Improper Maintenance: The warranty does not
cover the replacement of parts due to improper maintenance of the system and/or
the components of the system. Customers should store the computer in a clean
area at room temperature and should inspect the computer regularly for dust
buildup that may cause damage to system components. If you require assistance
with maintenance, you may contact our Customer Care staff at
customercare@abs.com .
2.8 Software: All software including the
operating system is 100% non-refundable once purchased and delivered.
2.9 Any signs of abuse or intentional damage to
the system will be documented and the warranty on this system will be voided.
The customer will also be required to pay for return shipping on the system. See
Section 10 for RMA Shipping Policies.
2.10. The warranty does not cover system damage due to extraneous events
not directly related to the workmanship or material of the system including but
not limited to surges, floods, fires, etc.
2.11 This warranty does not cover data and the availability and retention
of data stored on any storage medium on the system. ABS will format and/or
replace storage devices that may or may not contain customer data as necessary
in order to fulfill the obligations of the warranty. Customers are encouraged to
back up data regularly.
3. Physical Damage Policy
Physical damage to any product purchased from ABS will effectively void our
standard and/or Extended Warranty coverage.
Improper installation of CPU fans and/or improper clocking may cause CPUs to
chip or burn. CPUs that are chipped, burnt or have bent pins are considered
physically damaged and cannot be returned for refund or replacement. Physical
damage includes but is not limited to improper handling and/or any other type of
damage sustained by irregular usage.
ABS encounters bent pins regularly when inspecting physically damaged CPUs.
Forcing a processor into position will not solve an installation problem and may
result in applicable warranty coverage being voided.
Because Intel and AMD do not accept physically damaged processors, ABS will
return any physically damaged CPU to you at your expense.
4. Notebook LCD Limited Warranty
Notebook LCDs are covered under the defective pixel warranty guidelines as
specified below for 1-Year from the date of invoice (defined as the date the
system is shipped by ABS).
1) Under 15?LCD ?6 or more defective (dead/stuck) pixels to be classified as
defective.
2) Over 15?LCD - 8 or more defective (dead/stuck) pixels to be classified as
defective.
5. Notebook Battery Warranty
ABS notebook batteries purchased with an ABS system are covered under a 90-day
warranty against defects in material and workmanship from the date of invoice
(defined as the date the system is shipped by ABS). All other batteries
purchased separately are covered under the Parts & Peripherals Warranty (See
section 7).
6. Barebook limited warranty
(A Barebook is a laptop bare-bone, the basic element of a notebook which does
not include all associated components, such as CPU, memory, hard drive, wireless
card, etc.)
6.1 Barebooks are not covered under the
standard ABS limited warranty. Customers may return unopened barebooks to ABS
within 14 days from invoice date (the date the barebook unit is shipped) with a
15% restocking fee. If any of the original items are missing, your return may be
denied and/or the restocking fee may increase. Customers are responsible for all
costs of return shipping to ABS.
6.2 ABS does not accept any requests for
refunds for any used or opened barebooks.
6.3 If you find any defects in your barebook or
find any items are missing, please contact ABS immediately (within 10 business
days from invoice date) for replacement of the product. When the RMA is
received, one of the following results will be determined:
a) If the barebook is not defective, the customer will be charged a $90
diagnostic fee and be responsible for return shipping (shipping from ABS to the
customer).
b) If the barebook is deemed defective, ABS will exchange the product and ship
it back to the customer at ABS' cost.
c) If the customer damages a barebook, the customer will be charged for the full
cost of the replacement and return shipping (shipping from ABS to the customer).
6.4 ABS will repair defective barebooks for 1
year with a non-refundable $90 diagnostic fee (ABS will charge $90.00 for each
time that customer sends the system to ABS for repair).
6.5 Turnaround times for repair are 3-4 weeks
from ABS' receipt of your defective barebook.
6.6 Barebook RMAs are not covered under the
provisions of the standard warranty. If a defective barebook is determined to be
damaged due to any reason other than a defect in workmanship/quality, the
customer will be charged for the full cost of the barebook for replacement and
return shipping (shipping from ABS to the customer).
6.7 If you have any questions about
installation, please refer to the service manual for set up instructions.
Installation is the sole responsibility of the customer and ABS does not make
any guarantees regarding installation of the product.
6.8 ABS is not responsible for providing
Technical Support for barebooks or any additional parts purchased for the
barebook. If you require help with parts compatibility or have questions
regarding assembly and/or design, please contact the specific Manufacturer.
7. Parts & Peripherals Warranty
7.1 7.1 All parts & peripherals purchased
through ABS are covered under our Standard 30-day Warranty against defects in
material and workmanship, unless otherwise noted in the product description.
Merchandise under our Standard 30-day Warranty may be returned for replacement
within 30 days of the original invoice date (defined as the date the components
are shipped by ABS). All returns require an RMA (Return Merchandise
Authorization) number. All parts & peripherals are not refundable; in other
words, all parts & peripherals from ABS are not eligible for the 30-day
Satisfaction Guarantee from ABS.
7.2 Damaged Items & Inspection Policy: Please
inspect your products upon arrival to check for any damages to the product.
Please inspect your computer and all parts & peripherals for damage upon
arrival. All claims must be reported to ABS within 10 days from the invoice date
or your claim will be denied.
7.3 Some parts & peripherals may have longer
warranties directly from the manufacturer of the product. Within the 30-day
warranty period, customers may choose to go through the ABS RMA procedure (See
section 8) to repair or replace their product. Customers may also elect to go
directly through the manufacturer of the product. ABS is an authorized reseller
for all of the brands that ABS carries.
7.4 CPU Warranty OEM CPUs
7.4.1 Refund period: 7 days from the original
invoice date
7.4.2 Replacement period: 30 days from original
invoice date
7.5 Retail CPUs
7.5.1 Refund period: 7 days from original
invoice date.
7.5.2 Replacement period: CPU manufacturers
generally offer a 3-year warranty on retail processors. Please contact the
manufacturer directly for specific warranty Terms and Conditions.
7. 6 Additional CPU warranty Terms
7.6.1 Declaring a CPU is defective and
requesting a Refund does not automatically waive the restocking fee.
7.6.2 All defective and DOA CPUs will be
replaced upon return.
7.6.3 ABS will not cross-ship replacement CPUs.
7.6.4 Your
return must be postmarked within 7 days of the original invoice date to qualify
for a refund.
7.6.5 Physical damage of any kind will void any
applicable Standard or Extended warranty coverage.
8. Outlet Systems Warranty
Outlet store systems are covered under a standard 90-day warranty against
defects in material and workmanship from the date of invoice (defined as the
date the system is shipped by ABS) unless noted on the product description. All
systems purchased from the outlet store are not refundable; in other words, all
systems purchased from the outlet store are not eligible for the 30-day
Satisfaction Guarantee from ABS).
9. 30-day Satisfaction Guarantee
If for any reason you are not completely satisfied with your ABS system, you may
return it to ABS within 30 days from the invoice date (defined as the date the
system is shipped by ABS) for a refund of the system price minus a 15%
restocking fee. Software including the operating system, missing and/or damaged
items, and shipping cost will not be refunded. Systems purchased from the outlet
store are excluded from the 30-day Satisfaction Guarantee from ABS.
10. RMA Procedure
10.1 The RMA Number must appear clearly and
legibly on the exterior of every package sent to ABS. Please use a thick
permanent marker to mark at least two sides of the box with the RMA number you
are assigned. If a box is missing the RMA number, delivery of the package will
be refused by ABS. Please follow the directions below:
10.2 Your RMA number is valid for 10 business
days from the date that it was issued to you. Systems and/or parts received for
RMA after the expiration of the RMA number will be assessed a $60 service and
handling charge.
10.3 For RMA Repairs:

For desktop repair service, send back only what you were asked to send by the
Customer Care agent. For system repairs, do not send any power cords, software,
or accessories.
For notebook repair service, please send the AC Adapter, Battery, and Optical
Drive along with the complete notebook unit. (Onsite service is not available
for notebooks)
Any repair orders that are missing any of the listed items will be rejected. ABS
will not pay any additional shipping charges incurred for shipping missing
items.
"Out of Warranty" service and "No Trouble Found" items will be charged $60/hr
for labor and diagnostics (2 hr minimum) plus the prices of repair parts and
return shipping & handling costs. In the event a system is determined to be “Out
of Warranty?or “No Trouble Found,?ABS will obtain the customer's permission to
proceed with repairs prior to incurring any charges.

All returned items must include 100% of the original content, along with
manufacturer's box, packing material, and documentation. If any of these items
are missing, returned items may be denied refund.
10.5 Shipping Policy
Shipping
ABS is not responsible for lost or damaged packages during the shipping process.
You must use FedEx, UPS, or DHL to ship the package back to ABS to ensure proof
of delivery as well as insure the package against damages and loss. Please pack
the computer back into the original box, if possible, or pack it securely within
the box you use.
On Systems: Within the first 30 days from the invoice date, ABS will cover 2-way
standard shipping for the repair or replacement of the system within the
Continental United States. After the initial 30 days and within the warranty
period, the customer is responsible only for shipping to ABS.
On Parts & Peripherals: The customer is responsible only for paying shipping to
ABS within the warranty period.
Abandoned Systems Policy: If a customer refuses to pay for return shipping as
set out in the service and warranty guidelines, ABS will hold the system for up
to 45 days after which the system will be considered “abandoned?and ABS will
relinquish responsibility for the system and will dispose of the system
accordingly.
10.6 Advanced Replacement Policy Corporate Buyers Only
Advanced replacement can be requested if replacement parts are needed immediately.
Customers must ship the original item back to ABS within 10 days of this request.
For all Advance Replacement transactions, a credit card number is required and will
be held to ensure the return of the original item. There will be a 10-day hold for
the current price of the item being shipped. If the item is not received within
10 calendar days of the request, ABS will charge the credit card accordingly. Requests
received after 4:00PM PST will be processed the following business day.
Please follow the following procedures to request Advance Replacement:
Contact the ABS Customer Care Department at (800) 685-3471 for assistance. If the
problem is determined as hardware failure by ABS, the customer may proceed to request
Advance Replacement:
1. Download and fill out the Advance
Replacement Form .
2. Fax the completed form to (562) 908-8863 or email it to
customercare@abs.com
3. Return the original defective product to ABS Computer Technologies, Inc. within
10 days from the date ABS sends out the replacement product.
Legal Guidelines
1. WARRANTIES
ABS Branded products come with a 1-year limited warranty; this limited warranty
covers defects in materials, workmanship and technical support directly from ABS
Computer. Products sold by ABS Computer that are not manufactured by ABS Computer
may however, be covered by each manufacturer's warranty, service, and support
policy (if any). ABS Computer assigns and passes through to the Customer any warranty
of the manufacturer, and Customer acknowledges that it shall have recourse only
under such warranties and only as against the manufacturer of the products.
ABS COMPUTER MAKES NO REPRESENTATION OR EXPRESS WARRANTY WITH RESPECT TO THE PRODUCT
EXCEPT THOSE STATED IN THIS DOCUMENT. ABS COMPUTER DISCLAIMS ALL OTHER WARRANTIES,
EXPRESS OR IMPLIED, AS TO ANY SUCH PRODUCT, INCLUDING AND WITHOUT LIMITATION, THE
IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULARPURPOSE, AND ANY
IMPLIED WARRANTIES ARISING FROM STATUTE, TRADE USAGE, COURSE OF DEALING, OR COURSE
OF PERFORMANCE TO THE FULLEST EXTENT PERMITTED BY LAW.
2. LIMITATION OF LIABILITY IN ALL CIRCUMSTANCES,
ABS COMPUTER'S MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS
SOLD BY ABS COMPUTER. ABS COMPUTER SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE
UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR ANY OTHER
LEGAL THEORY RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT.
ABS COMPUTER SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE
CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS,
LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT ABS COMPUTER IS APPRISED OF
THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.
3. GENERAL TERMS AND CONDITIONS
(a) Payment Terms; Orders:
An order is not binding upon ABS Computer until it is accepted; ABS Computer must
receive payment before it will accept an order. Payment for product(s) ordered is
due prior to shipment. Customer can make payment by credit card, wire transfer,
or some other method prearranged with ABS Computer. You agree to pay the amount(s)
due as specified on the invoice, and you agree to pay interest on all past-due sums
at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.
(b) Shipping Charges:
Your total cost for purchase of any product will include shipping and handling charges
shown on the ABS Computer invoice.
(c) Title; Risk of Loss:
ABS Computer will arrange for shipment of ordered product(s) to the Customer, Free
On Board (F.O.B.) shipping point, meaning title to the product(s) -- excepting software--
and risk of loss passes to the Customer upon delivery to the carrier. ABS Computer
reserves a purchase money security interest in the product(s) until ABS' receipt
of the full amount due. Customer agrees to allow ABS Computer to sign appropriate
documents on Customer's behalf to permit ABS Computer to protect its purchase
money security interest. Title to software will remain with the licensor(s). All
software is provided subject to the license agreement of the software maker. Customer
agrees to be bound by any software license agreement once the seal on the package
is broken. ABS Computer will advise Customer of estimated shipping dates, but ABS
Computer will, under no circumstances, be responsible for delays in delivery, and
associated damages, due to events beyond its reasonable control, including without
limitation, acts of God or public enemy, acts of federal, state or local government,
fire, floods, civil disobedience, strikes, lockouts, and freight embargoes.
(d) Governing Law and Jurisdiction:
Any dispute arising out of or related to these Terms and Conditions or the sales
transaction between ABS Computer and Customer shall be governed by the laws of the
State of California, without regard to its conflicts of law rules. Specifically,
the validity, interpretation, and performance of this agreement shall not be governed
by the United Nations Convention on the International Sale of Goods. ABS Computer
and Customer consent to the exclusive jurisdiction and the venue of the State Courts
of the State of California, Los Angeles County, to resolve any dispute between them
related hereto, and the parities waive all rights to contest this exclusive jurisdiction
and venue of such Courts. Finally, the Customer also agree not to bring any legal
action, based upon any legal theory including contract, tort, equity or otherwise,
against ABS Computer that is more than one year after the date of the applicable
invoice.
(e) Severability:
If any provision contained in this agreement is or becomes invalid, illegal, or
unenforceable in whole or in part, such invalidity, illegality, or unenforceability
shall not affect the remaining provisions and portions of this agreement, and the
invalid, illegal, or unenforceable provision shall be deemed modified so as to have
the most similar result that is valid and enforceable under applicable California
law.
(f) Waiver:
The failure of either party to require performance by the other party of any provision
of this agreement shall not affect in any way the first party's right to require
such performance at any time thereafter. Any waiver by either party of a breach
of any provision in this agreement shall not be taken or held by the other party
to be a continuing waiver of that provision unless such continuing waiver is made
in writing.
(g) Entire Agreement:
These terms and conditions, together with the ABS Computer's invoice respecting
the products ordered by Customer, are the complete and exclusive agreement between
ABS Computer and Customer, and they supersede all prior or contemporaneous proposals,
oral or written, understandings, representations, conditions, warranties, and all
other communications between ABS Computer and Customer relating to the subject products.
This agreement may not be explained or supplemented by any prior course of dealings
or trade by custom or usage.
